These terms apply to every sale by Horeb Nursery Inc..
Quotes and prices
- Prices are per plant, before tax, picked up at the farm, and can change weekly.
- Written quotes are good for 7 days.
- Volume pricing depends on the total number of plants in the order, of any size.
Payment
- New accounts pay up front, or 50% to reserve and the rest before we unload.
- Credit terms are for approved accounts only.
- Invoices more than 15 days late are charged 1.5% a month, and new orders wait until the account is current.
Sales tax
We charge Florida sales tax where it applies. Resellers with a valid Florida Annual Resale Certificate are exempt; we verify the certificate.
Delivery and pickup
- Delivery fees depend on the zone and are listed on their own line.
- Someone must be on site to show us where to unload.
- Risk passes to the buyer at delivery or pickup.
Inspection and claims
Please check the plants at loading or delivery, and tell us about any problem within 48 hours, with photos. We replace plants that aren't healthy or true to the quoted size on arrival; we don't give cash refunds. We don't cover damage after planting, frost, flooding or watering problems.
Heights and photos
Heights are measured from the top of the pot. Plants are living things and vary a little within each size; photos show the block your plants come from.
Lien rights
For plants delivered to a job site, we may send a Notice to Owner and use the lien rights Florida law allows.
Governing law
These terms are governed by Florida law. Any dispute will be handled in Miami-Dade County.
